A2D Single Use License Agreement

Single-Use License Terms

Use of this plan is unauthorized without a valid plan license number and a fully executed license agreement with Ahmedic Designs/A2D House Plans.

A2D House Plans/Ahmedic Designs, Inc. grants the Licensee the right to use the purchased plan for construction of one (1), and only one, single-family residence at the build location identified above.

Plan Use and Additional Services

1. Design Modifications: Licensee may modify the drawings as required for the one-time use listed above.

2. Fees: The fee for use of the plans shall be paid to A2D House Plans. After receiving the signed license agreement and the address where the home will be constructed, A2D House Plans will email the files to Licensee. The files may be used to construct one (1), and only one, single-family residence.

3. Structural Engineering/Certification: Final Construction Drawings may require certification. A2D House Plans will not provide structural engineering or certification unless separately contracted to do so. Because site conditions, weather conditions and local codes vary, Licensee should retain a local certified structural engineer.

4. Electrical, HVAC and Plumbing Details: Items such as electrical riser diagrams, panel schedules, load calculations, plumbing riser diagrams and HVAC layouts may be required for permitting. These are normally supplied by the contractor or subcontractors. A2D House Plans may provide them under a separate contract.

5. Landscape and Drainage Plans: These plans may be required by certain cities, counties or developments. They are not included unless provided under a separate contract.

Copyright and Transfer Restrictions

6. Copyright: Licensee acknowledges that the Plan and all derivatives remain the exclusive property of Ahmedic Designs, Inc. Licensee receives only the limited single-use rights described in this agreement. Licensee may not create or authorize other changes, modifications or derivative works beyond that single use. A2D House Plans retains ownership of all changes, modifications and derivative works but is not obligated to provide design or drafting services under this agreement. Copyright notices must remain on every file issued to the Client.

7. Assignment: This license may not be assigned or transferred without the express written consent of A2D House Plans.

Liability and Legal Terms

8. Errors and Omissions: A2D House Plans is not responsible for the means, methods, sequences or materials used to construct any residence from the Plan or its derivatives, or for ensuring construction conforms to them. If the Plan or a derivative contains an error, A2D House Plans’ liability for damages is limited to the compensation it received under this agreement.

9. Attorney’s Fees: In any action to enforce this agreement, whether or not a lawsuit is filed, the prevailing party is entitled to reasonable attorney’s fees.

10. Choice of Law and Venue: This agreement is governed by Florida law. Venue shall be in Lee County, Florida.

11. Entire Agreement and Modification: This agreement represents the parties’ entire agreement and supersedes all prior written or oral negotiations and understandings. It may be modified only in writing.
